Intellectual Property Policy

The Chartered Alternative Investment Analyst Association, Inc. (the “CAIA Association®”) owns or has rights in the following marks (collectively, the “CAIASM Marks”):

  • CAIASM
  • Chartered Alternative Investment AnalystSM
  • CAIA Association®
  • Chartered Alternative Investment Analyst Association®

The CAIA Association® may grant the right to use the CAIASM Marks to those individuals who have been granted the status of either “Full Member” or “Retired Member” by the CAIA Association®.  Only individuals who have been granted such status (each such individual is hereinafter referred to as a “Member”, and such status as “Membership”), but not those individuals who have only been granted the status of “Affiliate Member,” may be granted the right to use the CAIASM Marks. 

If the CAIA Association® revokes a Member’s Membership for any reason, or if such Membership is otherwise terminated or allowed to expire, including for failure to pay any Membership dues when the same are due, (such Member, a “Terminated Member”) any right to use the CAIASM Marks previously granted to the Terminated Member shall be automatically revoked, effective immediately upon the date of such revocation or expiration, as the case may be.  Sixty (60) days from the date of such revocation or expiration, the Terminated Member shall have ceased all use of the CAIASM Marks and shall affirm such cessation to the CAIA Association® at the fax number or e-mail address set forth below.  If the Terminated Member fails to (1) cease using all of the CAIASM Marks by the end of such sixty (60)-day period, or (2) affirm such cessation to the CAIA Association®, then the Terminated Member shall indemnify and hold harmless the CAIA Association® for all costs incurred, including but not limited to attorney’s fees and costs, in obtaining the Terminated Member’s compliance with such requirements.

A Member’s usage of the CAIASM Marks is subject to compliance with the guidelines set forth below.

In order to maintain the significance and exclusivity of the CAIASM Marks, any Member granted the right to use the CAIASM Marks by the CAIA Association® shall consult and abide by the following guidelines when using the CAIASM Marks for any purpose (including, for example, when preparing business cards, letterhead, promotional literature, signage, and any other form of printed, electronic and written communication).  The examples set forth below are intended to illustrate proper usage of the CAIASM Marks.  Any questions regarding proper usage of the CAIASM Marks should be directed to the CAIA Association® staff by fax at 413-253-4494 or by e-mail at member@caia.org.

The CAIASM Marks are recognized symbols of the education and expertise that distinguish the CAIA Association®’s Members from other investment professionals.  If used improperly, the CAIA Association® may lose its exclusive rights to the CAIASM Marks, and persons who have not met the requirements for Membership may nevertheless be able to use the CAIASM Marks.  To protect the rights of all Members, the CAIA Association® monitors and enforces proper usage of the CAIASM Marks worldwide.  The CAIA Association® requests that Members help it monitor by reporting any suspected improper usage of the CAIASM Marks to the CAIA Association®.


I.  Certification Marks

  • Chartered Alternative Investment AnalystSM
  • CAIASM

Purpose

The CAIA Association®’s certification marks have a very specific and limited purpose:  they indicate that the Member using them has taken all of the CAIA Association®’s required courses, passed all of the CAIA Association®’s required examinations, and has been granted Membership by the CAIA Association®.   These certification marks are a critical means of assuring the public that it can always expect a high level of training and expertise when the CAIASM and Chartered Alternative Investment AnalystSM designations are used.

Please keep in mind, however, what these marks do NOT mean. They do not constitute a warranty, either by the CAIA Association® or by the individual member, as to the quality of the services rendered in any individual case. The CAIA Association® can never be held responsible for errors or omissions by individual members in the course of rendering services to clients.

Proper Use
The certification marks are typically used after the Member’s name.  For example:

  • Adam Roberts, CAIASM
    -OR-
    Adam Roberts, CAIA
  • Jane Smith, Chartered Alternative Investment AnalystSM
    -OR-
    Jane Smith, Chartered Alternative Investment Analyst

II.   Collective Membership Marks

  • Chartered Alternative Investment Analyst Association®
  • CAIA Association®

Purpose

The purpose of the collective membership marks is essentially the same as that of the certification marks above:  to assure the public that the person using the collective membership marks is a Member of the CAIA Association®.

Proper Use

The collective membership marks are typically preceded by the word “Member” and come after the Member’s name.  The ® symbol should be placed in close proximity to the collective membership marks wherever they appear (including, for example, on business cards, website advertisements, etc.).  For example:

  • Jane Smith, Member, CAIA Association®
  • Adam Roberts, Member, Chartered Alternative Investment Analyst Association®

III.  Service Marks

  • CAIASM
  • CAIA Association®
  • Chartered Alternative Investment AnalystSM
  • Chartered Alternative Investment Analyst Association®

Purpose

The service marks are primarily intended for use by the CAIA Association® to identify itself and its programs, in contrast to the certification and collective membership marks which are used exclusively by Members.   There are limited circumstances when a Member should use the service marks instead of the certification marks or collective membership marks.

Proper Use
The service marks may be used in the text of magazine and newspaper articles, books, advertising, and in textual or verbal contexts where use of the certification marks or collective membership marks is impossible or impractical.  When the service marks are so used, Members should carefully advise reporters, authors, editors, publishers, and others as to the guidelines of proper usage.

The service marks must not be used generically and should only be used as an adjective so that it does not become generic and used as a common name for a category of products or services.  Reference to all alternative investment analysts as “CAIAs” would be improper and will lead to that service mark becoming generic and losing all of its value (like has happened with facial tissues (Kleenex) and photocopies (Xeroxes)).  If the use becomes generic, Members will lose their exclusive right to use of these valuable service marks.

Examples of proper use of the service marks are:

  • Adam Roberts is a CAIASM Charter Holder
    -OR-
    Adam Roberts is a CAIA Charter Holder
  • Jane Smith, CAIASM, is a portfolio manager
    -OR-
    Jane Smith, CAIA, is a portfolio manager

Improper Use

Examples of improper use of the service marks are:

  • Adam Roberts is a CAIA.
  • Adam Roberts and Jane Smith are CAIAs.

NOTE:  The first and most prominent use of the CAIASM and Chartered Alternative Investment AnalystSM marks in text material should include the service mark symbol (SM).  It is not necessary to use the service mark symbol when the marks directly refer to a specific individual.  The Chartered Alternative Investment Analyst Association® and CAIA Association® marks are federally registered and so the federal symbol (R) must be used with these marks wherever they appear.

It must always be specified in a tag line at the end of an article and at the bottom of an advertisement or promotional literature that the CAIASM Marks are the property of CAIA Association®, for example:

  • CAIASM and Chartered Alternative Investment AnalystSM are service marks owned by CAIA Association®.

The CAIASM mark must appear in all capital letters.  This rule applies even if you have chosen an all-lower-case design for your letterhead or business cards; there are no exceptions.  With respect to the Chartered Alternative Investment AnalystSM and Chartered Alternative Investment Analyst Association® marks, the first letter of each word must always be capitalized.

Examples of proper use of the service marks are:

  • Adam Roberts, CAIASM
    -OR-
    adam roberts, CAIASM
  • Adam Roberts, Chartered Alternative Investment AnalystSM

Examples of improper use of the service marks are:

  • Jane Smith ,caiaSM
    -OR-
    jane smith, caiaSM
  • Jane Smith is a chartered alternative investment analystsm

The form of the service marks must never be altered to create a new word, phrase, or design, and they must never be used in the plural or possessive forms.

Examples of improper use of the service marks are:

  • Adam Roberts holds a certificate in Chartered Alternative Investing Analysis
  • Jane Smith, Chartered Analyst in Investing Alternatives
  • Adam Roberts, Chartered Alternative International Investing Analyst

The CAIASM Marks must not be used as part of, or incorporated in, the name of a company or imply that the company is entitled to use the CAIASM Marks.  Additionally, the CAIASM Marks may not be used in a Member's email address or in a personal or company domain name.  These designations apply only to individuals.

Examples of improper use of the service marks are:

  • Jane Smith, Inc., Chartered Alternative Investment AnalystSM
  • Jane Smith CAIA, Inc.
  • adamrobertscaia.com
